IMPORTANT NOTICE: THIS AGREEMENT CONTAINS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.

1. ACCEPTANCE OF TERMS

This Terms of Use Agreement ("Agreement") is a legally binding contract between you ("User," "you," or "your") and COASTAL AWAKENING LTD ("Company," "we," "us," or "our"). This Agreement governs your access to and use of our website, mobile applications, APIs, user accounts, gameplay features, customer support services, and all related digital content (collectively, the "Services").

By registering an account, accessing, or using any Services, you confirm that you have read, understood, and unconditionally agree to be bound by all terms herein. If you do not accept this Agreement, you must immediately cease using the Services.

2. MODIFICATION OF TERMS

2.1 Updates

We reserve the right to modify this Agreement at our sole discretion. Material changes will be communicated via email and in-service notifications at least 30 days before taking effect.

2.2 Continued Use

Your continued use of Services after modifications constitutes acceptance of revised terms.

2.3 Incorporated Policies

Our Privacy Policy, Responsible Gaming Policy, and Sweepstakes Rules are incorporated by reference. In case of conflict, this Agreement prevails unless explicitly stated otherwise.

3. SERVICE LICENSE AND RESTRICTIONS

3.1 Virtual Currency License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use virtual currency (including Gold Coins) within the Services ecosystem.

3.2 Prohibited Activities

Selling, leasing, or commercially exploiting virtual currency

Transferring accounts or claiming inheritance rights

Cross-platform currency exchange

Third-party marketplace transactions

Violations may result in account termination, asset forfeiture, permanent banning, and legal action.

3.3 Intellectual Property

All Service elements remain our exclusive property. No intellectual property license is granted beyond limited use rights explicitly stated herein.

4. ELIGIBILITY REQUIREMENTS

4.1 Qualification Criteria

You represent and warrant that you:

Are at least 18 years old or age of legal majority in your jurisdiction

Are not a resident of prohibited jurisdictions (Washington, Idaho, Quebec, Ontario)

Maintain only one lifetime account

Provide accurate, verifiable registration information

Use Services exclusively for personal entertainment

4.2 Compliance Monitoring

We employ verification systems including:

Geolocation tracking

Identity validation

Behavioral pattern analysis

Payment method verification

Non-compliance may result in immediate account suspension.

5. ACCOUNT MANAGEMENT

5.1 User Responsibilities

You are solely responsible for:

Maintaining current account information

Implementing strong security measures

Preventing unauthorized access

Reporting suspected account compromises

5.2 Account Inactivity

Accounts inactive for 60 consecutive days may be permanently closed with all virtual assets forfeited.

5.3 Voluntary Termination

Account closure requests must be submitted through verified channels. Termination results in irreversible loss of all virtual currency, game progress, and entitlements.

6. CONTENT PROVISIONS

6.1 User Content License

By submitting content, you grant us a perpetual, worldwide, royalty-free license to use, modify, distribute, and commercialize such content.

6.2 Content Standards

Prohibited content includes:

Copyright-infringing material

Defamatory, harassing, or abusive communications

Commercial solicitations

Malware, viruses, or phishing links

We reserve the right to remove prohibited content without notice or liability.

7. SERVICE DISCLAIMERS

7.1 Availability

Services are provided "AS IS" and "AS AVAILABLE." We make no warranties regarding uninterrupted operation, error-free performance, or equipment compatibility.

7.2 Technical Limitations

We are not liable for:

Service interruptions or degradation

Data transmission errors

Third-party infrastructure failures

Gameplay disruptions from technical malfunctions

8. LIABILITY FRAMEWORK

8.1 Damage Cap

Our maximum aggregate liability shall not exceed the total amount you paid to us during the six months preceding the incident giving rise to the claim.

8.2 Indemnification

You agree to defend, indemnify, and hold us harmless from all claims arising from:

Your violation of this Agreement

Your misuse of the Services

9. GOVERNING LAW AND DISPUTE RESOLUTION

9.1 Jurisdiction

This Agreement shall be governed by Delaware law, excluding conflict of law principles.

9.2 Arbitration

All disputes shall be resolved through binding arbitration administered by AAA under its Commercial Arbitration Rules, conducted in Delaware in English.

9.3 Class Action Waiver

Claims must be brought individually. Class actions, consolidated actions, or representative proceedings are not permitted.
